====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-12-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 103(1), 308(2), 61(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. As per F.I.R., five named accused including these petitioners and some unknown persons surrounded son of the informant and thereafter, it is alleged that co-accused Munna Kumar, fired from pistol which hit on his stomach due to which he got injured and subsequently, died during course of treatment.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. As per

Patna High Court CR. MISC. No.68014 of 2025(3) dt.08-12-2025 2/2 F.I.R., specific allegation of firing is against co-accused Munna Kumar. In post-mortem report, only one firearms injury was found on the person of deceased. Allegation against these petitioners is general and omnibus and there is no specific accusation of overt act against them.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Samastipur in connection with Halai P. S. Case No. 91 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
