JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 31-01-2024 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Muffasil P.S. Case No.303 of 2023 registered under Sections 304(B) and 34 of the I.P.C.

3. As per prosecution case, it is alleged that the daughter of the informant was subjected to torture in different ways by the petitioner and her family members due to nonfulfillment of demand of dowry and ultimately the daughter of informant was killed by them.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.70898 of 2023(3) dt.31-01-2024 2/2 case. There is no specific allegation of abuse and assault against the petitioner, who is aged about 65 years. The petitioner is mother-in-law of the deceased and she is living separately. She has no concern with the family affairs of the deceased and deceased's husband. The husband of the deceased is in custody. It is further submitted that similarly situated co-accused persons, namely, Moti Kumari and Amit Kumar @ Amit Choudhary have already been granted bail by a coordinate bench of this Court vide order dated 15.09.2023 passed in Cr.Misc.No.62105 of 2023. The petitioner is in custody since 18.08.2023.

5. Learned counsel for the informant and learned A.P.P. oppose the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case, submissions of the parties as well as the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S. Case No.303 of 2023.
