2. The petitioner has prayed for bail in connection with Warisaliganj P.S. Case No. 308 of 2025 registered for the offence punishable under Sections 126(2), 329(3), 115(2), 74, 76, 110, 118(1), 3(5) of the B.N.S., 2023.

3. The case of the prosecution is that the petitioner has assaulted with an iron rod on the head of Santosh Kumar.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that there is land dispute between the

Patna High Court CR. MISC. No.68215 of 2025(2) dt.24-09-2025 2/2 parties and there is also a counter version of this case. It has also been submitted that there is only one single blow. He further submits that petitioner is languishing in judicial custody since 05.07.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of four cases. He also submits that from perusal of the injury report, it will transpire that the injured has received swelling over the right temporal region of the head of diameter (2 inch x 2 inch), which is grievous in nature.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Nawadah in connection with Warisaliganj P.S. Case No. 308 of 2025.
