JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2018 Heard learned counsel for the petitioners and the state. The petitioner is in custody in connection with Mehsi P.S. Case No. 48 of 2017 for the offences registered under Sections 147, 143, 186, 224, 225, 307, 353/34 of the Indian Penal Code and Section 37B, 45 of the Bihar Prohibition and excise Act, 2016.

Learned counsel for the petitioners submits that petitioners are in custody since 08.05.2018. Referring to the other co-accused Milan Sahani and Shyam Sahani he submitted that Milan Sahani and Shyam Sahani have been granted anticipatory bail by the co-ordinate bench of this Court it would be evident from Annexure-3 and Annexure-3/1.

No.54812 of 2018(2) dt.28-09-2018 2/2 Considering the fact that the petitioners have remained in custody since 08.05.2018 and other co-accused have been granted anticipatory bail as indicated hereinabove, let the petitioner, named above are directed to be released on bail after 21.10.2018 on furnishing bail bond of Rs.10000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cumSpecial Judge Excise, Motihari, East Chmparan in connection with Mehsi P.S. case no. 48 of 2017.
