JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Kanti P.S. Case No.460/2018 for the offence registered under Sections 30(a)/38/41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He is in custody since 01.08.2018. He further submits that the petitioner is in custody in connection with seizure of 362.200 litres of liquor. He submits that nothing was recovered from the possession of the petitioner. The liquor was recovered from Tata Tigore vehicle. The petitioner is neither driver nor owner of the vehicle. He was arrested while he was passing through the road when the vehicle carrying liquor was intercepted by the police.
