JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 14-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Parsa Bazar P.S. Case No. 328 of 2021, registered for the offences punishable under Sections 302, 34 of the Indian Penal Code and Section 27 of Arms Act.

The informant in his fardbeyan alleged that when his brother was returning to his house after purchasing some grocery, he was shot dead by two unknown persons, who were crossing on railway tracks.

The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. It appears from perusal of impugned order that after investigation, the case

Patna High Court CR. MISC. No.69249 of 2022(2) dt.14-03-2023 2/2 was found true against the petitioner and other co-accused persons. The charge-sheet has been submitted under Section 302 of the IPC, read with Section 34 of the IPC and 27 of the Arms Act. The bail petition of other co-accused persons has been rejected.

In my view, the petitioner does not deserve the privilege for regular bail. Accordingly, it is rejected. It is expected that the trial shall be concluded within a period of one and half years.
