JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 19-09-2018 Heard learned counsel for the petitioner and counsel appearing on behalf of the Additional Public Prosecutor. The petitioner seeks regular bail in connection with Jadia P.S. Case No.86 of 2018, registered under Sections 363, 365, 34 of the Indian Penal Code.
Informant who is mother of the alleged victim, aged about 15 years disclosed that in her absence Suresh Ram and Buchhai Ram took him away. When she returned from harvesting, began to search the victim on account of his absence and during course thereof, Jagdeo Ram disclosed that he had seen his son at the house of Baldeo Ram. When she had gone to the house of Baldeo Ram, he (victim) was allured and then got him displaced from his place. He further disclosed that he had gone to Punjab. Victim
Patna High Court Cr.Misc. No.53631 of 2018 (2) dt.19-09-2018 has been traced out. In his statement under Section 164 Cr.P.C. has stated that petitioner along with others persuaded him to go to Punjab along with Budhu Ram in order to do menial work. He accordingly proceeded. When they reached at Patna, Budhu Ram handed him over to somebody else. They came at Jammu. He became suspicious from his activity whereupon, he came to Bus stand wherever he met with a person from Bihar, accompanied with him, stayed with him for ones half month and then thereafter returned back along with another person.
In the aforesaid facts and circumstances of the case coupled with period of detention since 09.06.2018, let the petitioner, Buchhai Ram, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-Vth, Supaul, in connection with Jadia P.S.
