JUSTICE SANJAY PRIYA ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Kanti P. S. Case No 233 of 2018 instituted for the offence under Section(s) 400, 413 and 414 Indian Penal Code.

Learned counsel for the petitioner has submitted that he has been arrested by the police merely on suspicion. It is mentioned in the written report that police got information that some dacoits have come with looted trucks and some of the culprits were sitting in a Bolero Vehicle. Police reached near the Glokal Hospital and seeing the police vehicle four persons jumped from the alleged truck and Bolero car and started running away. The police apprehended six accused persons

Patna High Court Cr.Misc. No.53723 of 2018(3) dt.01-10-2018 2/2 which included this petitioner. One of the accused who has been apprehended by the police along with the petitioner, namely Shambhu Chaudhary has already been granted bail by coordinate Bench of this Court vide order 14.9.2018 passed in Cr. Misc. no. 50120 of 2018 Petitioner is in custody since 12.5.2018 Learned counsel for the informant has appeared and opposed the prayer for bail.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Muzaffarpur, in connection with Kanti P. S. Case No 233 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
