The petitioners apprehend their arrest in connection with Surajgarha (Manikpur) P.S. Case No. 180 of 2019, registered under Section 307 and other allied Sections of the
Patna High Court CR. MISC. No.64247 of 2019(2) dt.22-10-2019 2/3 Indian Penal Code.
The accusation is that on 19.06.2019, 13 persons named in the F.I.R. including the petitioners and 5-6 unknown came at Gairmajarua land of Plot No. 3341, Khata No. 683, which is situated in front of Plot No. 3340 of informant and put hut there. When the informant made protest then Shashi Paswan (petitioner no.7) caused injury to him through lathi. When his uncle and brother came to save him then they were also assaulted through iron rod. At that time, they also snatched gold locket from the neck of his uncle and ring from his brother. Learned counsel for the petitioners submits that due to land dispute occurrence took place, in which, petitioners' side also sustained injury, regarding which, Surajgarha (Manikpur) P.S. Case No. 179 of 2019 is also instituted on the basis of Fradbeyan of petitioner no.1.
Moreover, while three injuries as found on the persons of informant, but only injury no. 3 fracture at his hand was grievous in nature wheres three injuries as found on the person of the uncle of the informant, i.e., lacerated wound on finger are said to be grievous in nature. Further submission is that petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the
Patna High Court CR. MISC. No.64247 of 2019(2) dt.22-10-2019 3/3 case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Lakhisarai, in connection with Surajgarha (Manikpur) P.S. Case No. 180 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
