JUSTICE SANJAY PRIYA ORAL ORDER 03-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Muzaffarpur Town P.S. Case No. 138 of 2018 instituted for the offence under Sections 399, 402 of I.P.C., Sections 25(1-b), 26 and 35 of the Arms Act. Counsel for the petitioner submits that petitioner is in custody since 25.02.2018.

It is alleged in the written report that one country made pistol and one cartridge have been recovered from possession of the petitioner.

Keeping in view the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.53861 of 2018 (2) dt.03-10-2018 2/2 amount each to the satisfaction of learned Additional Chief Judicial Magistrate-6th, Muzaffarpur, in connection with Muzaffarpur Town P.S. Case No. 138 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.

The petitioner will cooperate in conclusion of the trial. He will remain present on each and every date of trial till disposal of the case. He will not try to tamper with the evidence or intimidate the witnesses to delay the disposal of trial. In the event of default of two consecutive dates, his bail bonds will liable to be cancelled.
