Petitioner, in the present case, is questioning the order passed by the disciplinary authority vide memo no. 309 dated 16.03.2022 by which deduction from pension amount of the petitioner at the rate of 20% has been ordered. Learned counsel for the State submits that the petitioner has an alternative statutory remedy of appeal under

Patna High Court CWJC No.46 of 2023(4) dt.12-05-2023 2/2 Rule 24 of the Bihar CCA Rules, 2005 which he has not availed and has directly moved to this Court.

In view of an alternative statutory remedy of appeal available to the petitioner, this Court is not inclined to entertain this writ application. It is being disposed of with liberty to the petitioner to avail his remedy in appeal.

If an appeal is preferred within a period of 30 days from today, the same will be considered by the appellate authority on it's own merit.
