The petitioner has been in custody since 02.01.2018 in connection with Aurangabad Town P.S. Case No. 357/2017 registered for the offences punishable under Sections 468/471/420/120(B)/34 of the Indian Penal Code. The present application for renewing the prayer for bail has been filed in view of the liberty given to the petitioner to renew his prayer for bail after framing of charge. Learned counsel for the petitioner submits that now the charge has been framed vide order dated 02.07.2018 (Annexure-5) which was not known to the petitioner at the time
Patna High Court Cr.Misc. No.55181 of 2018 (2) dt.05-09-2018 2/3 of disposal of the earlier petition. He thus prays that the petitioner may be extended the privilege of bail. Having heard learned counsel for the petitioner and learned counsel appearing on behalf of the State and after considering the fact that the petitioner is willing to co-operate in the trial and shall appear at all material dates, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P.S. Case No. 357/2017, subject to the following conditions:-
(1) Father of the petitioner will be the bailor.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as
