JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with G.B. Nagar P.S. Case No. 104 of 2019 registered for the offence punishable under Section 363A of the Indian Penal Code.

As per FIR the petitioner is said to have kidnapped minor daughter of the informant and her statement recorded under Section 164 Cr.P.C. disclosed the involvement of the petitioner.

Submission of learned counsel for the petitioner is that there was love affair between one Manoj Nut and the victim girl and petitioner has falsely been implicated in this case. Heard learned APP, who has opposed the pray8er for anticipatory bail stating that victim girl has supported the

Patna High Court CR. MISC. No.64559 of 2019(2) dt.16-10-2019 2/2 prosecution case against the petitioner in her statement under Section 164 Cr.P.C.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

This application is, accordingly, dismissed.
