JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-10-2018 The petitioner seeks regular bail in connection with Farbesganj (Sibraha) P.S. Case No. 138 of 2018, registered for offences punishable under Sections 392/411 of Indian Penal Code. Allegation as per F.I.R. is of snatching the motorcycle and mobile phone of the informant. It has been submitted on behalf of the petitioner that he is not named in the F.I.R., his name has surfaced in this case only on the basis of confession of co-accused and except that there is nothing against the petitioner and he has been in judicial custody since 19.06.2018.
Heard learned A.P.P. also.
Having heard both sides, considering the fact and circumstances of the case and also the criminal antecedent of the
Patna High Court Cr.Misc. No.55967 of 2018 (2) dt.08-10-2018 petitioner, at this stage, I am not inclined to enlarge the petitioner on bail. However, once the petitioner completes five months in judicial custody, the court below shall release the petitioner on bail to his own satisfaction.
