The petitioner seeks bail in Shahkund (Sajour) P.S. Case No.111 of 2015, registered under Sections 328 and 394 of the Indian Penal Code.

The informant, Md. Mustkim alleged that while he was driving his truck, four persons came, assaulted the informant and snatched money and other articles from his pocket. The cleaner of the truck was also assaulted. The informant named four persons.

The learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner figured in the confessional statement of Sakho Das but save and except confession of Sakho Das, the Investigating Officer did not collect any further material against the petitioner. Patna High Court Cr.Misc. No.58480 of 2018(2) dt.20-09-2018 2/2 was not even put on TIP. Shakho Das @ Prashant Kumar has already been enlarged on bail vide order dated 30.11.2015, passed in Cr. Misc. No.53882 of 2015. The petitioner is in jail since 28.06.2018.

Taking into consideration the facts aforesaid that save and except the confession of accused, there is no other material against the petitioner, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhagalpur in connection with Shahkund (Sajour) P.S.
