The petitioner seeks bail in G.R. P.S. Case No. 256/2017, instituted for the offences under Sections 489B and 120B of the Indian Penal Code.

As per prosecution case, 155 fake currency notes of denomination of Rs. 50/- and 27 fake currency notes of Rs. 100/- denomination have been recovered from possession of this petitioner.

Learned counsel for the petitioner has submitted that even if assuming the allegation to be true, no case under Section 489B of the Indian Penal Code is made out. The case is made out

Patna High Court Cr.Misc. No.54050 of 2018 (2) dt.04-10-2018 2/2 under Section 489C, which is bailable. There is no allegation against this petitioner that he was using as genuine, forged or counterfeit currency notes or bank notes.

The petitioner is in custody since 22.12.2017. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Railway Court, Bhagalpur in connection with G.R. P.S. Case No. 256/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
