The petitioner apprehends his arrest in connection with Barun P.S. Case No. 93 of 2019, registered under Sections 379, 411 and 420/34 of the Indian Penal Code, Sections 4/40 BMMCR and Section 15 of the Environment Protection Act. The accusation is of seizing of three tractors attached with trailor loaded with illegal extracted sand, while the drivers of the said tractors succeeded to flee away. Learned counsel for the petitioner submits that, in fact, petitioner is the driver of Swaraj tractor attached with trailor loaded with sand, which was purchased from the market not from the Balu Ghat. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 93 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
