The petitioner apprehends arrest in connection with Lodipur Police Station Case No. 08 of 2016 registered for the offences under sections 302, 201/34 of the Indian Penal Code. It has been submitted that altogether four accused, who are named in the FIR, allegedly took away the son of informant and on the following day, the dead body of son of informant was recovered from Sardho More. Out of four FIR named accused, two accused namely Abhinandan and Guddu Kumar @ Dharmendra Mandal have already been allowed bail by different Bench of this Court in Cr. Misc. Nos. 30090 and 52662 of 2017 on 09.11.2017 and 24.07.2017. The petitioner was

Patna High Court Cr.Misc. No.1161 of 2018 (3) dt.01-02-2018 2/2 apprehended by Police and was detained in police station for 12 days and thereafter the process under section 82 of Criminal Procedure Code has been initiated against him. The petitioner has clean antecedent. He is neither named in FIR nor there is any specific allegation of overt act against him. Considering the facts and circumstances of the case, the prayer for bail is allowed and the above named petitioner in the event of arrest or surrender before the learned court below within six weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Bhagalpur in connection with Lodipur Police Station Case No. 08 of 2016, subject to conditions as laid down under section 438(2) Cr.P.C.
