JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2018 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Shahjahanpur P.S. Case No. 51 of 2018 (Special Case No. 6487 of 2018) for the offence under Sections 30(a) and 38 (i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent. The petitioners are in custody since 15.07.2018 in connection with seizure of 30 litres of Mahua liquor.

Considering the fact that the petitioners have remained in custody for more than two months and they have no criminal antecedent, the petitioners, named above, are directed to

Patna High Court Cr.Misc. No.54726 of 2018 (2) dt.28-09-2018 2/2 be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise Act), Patna in connection with Shahjahanpur P.S. Case No. 51 of 2018 (Special Case No. 6487 of 2018).
