The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 353, 307, 323 of the Indian Penal Code and Sections 4 and 5 of Explosive Substance Act.
The prosecution case, in short, is that the accused persons on account of allotment of hostel assembled and created chaos and obstructed in the duty of the informant and when the informant along with others tried to pacify them, some of the students got violent and scuffled with each other and fled away while exploding bomb.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against
Patna High Court Cr.Misc. No.54547 of 2018(2) dt.05-10-2018 2/2 the petitioner. The petitioner has been made accused due to mistake of fact. There is general and omnibus allegation levelled against the petitioner No one got injured in course of occurrence. Other co-accused was granted anticipatory bail vide order dated 29.08.2018 passed in Cr. Misc. No. 47574 of 2018. On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Pirbahore P.S. Case No. 503 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Pankaj/- U T
