The petitioner has prayed for regular bail in a case registered for the offence punishable under section 356, 379 of the Indian Penal Code.

As per prosecution case, informant alleged that while she was going towards her house after withdrawal of rupees three lack ten thousand (Rs. 3,10,000/-) from State Bank, Hajipur Branch, in the meantime, two unknown miscreants came on a motorcycle and snatched her purse containing the same amount along with other belongings thereafter, they fled away.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The

Patna High Court CR. MISC. No.1514 of 2023(3) dt.17-02-2023 2/2 petitioner is not named FIR and he has falsely been implicated in this case on the basis of suspicion. Neither the petitioner has been put on TIP nor any incriminating article has been recovered from his conscious possession which shows his complicity in the alleged occurrence. There is no consistent evidence available against the petitioner. Moreover, the petitioner is languishing in judicial custody since 01.08.2022. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner has got several criminal antecedents.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rajapakar P.S. Case No. 230 of 2019 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate. Vaishali at Hajipur.
