JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-08-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the respondent State. The only grievance involved in the present application is whether the petitioner is entitled to payment of subsistence allowance during the period of suspension on account of his judicial custody in connection with Pakribarwan P.S. Case No. 91 of 2005 under Section 302 of the Indian Penal Code. If the petitioner was put under suspension, it was obligatory on the part of respondents to pay subsistence allowance to the petitioner for the period of suspension. If the respondents have not paid subsistence allowance for the period of suspension, the

Necessary decision in this regard may be taken by the respondents within a maximum period of 60 days from the date of receipt/production of a copy of this order.
