JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel appearing on behalf the petitioner and counsel appearing on behalf of the State. The petitioner is in custody since 19.06.2018 in connection with Muffasil P.S. Case No. 341 of 2018 ( G.R. Case No. 3904 of 2018) registered for the offence under Section 457, 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Petitioner was apprehended along with co-accused Jabbar Mian. Learned counsel further submits that Jabbar Mian has already been granted bail by Coordinate Bench of this Court. Petitioner remains in custody since 19.6.2018.

Considering the aforesaid facts that petitioner has

No.54162 of 2018(2) dt.20-09-2018 2/2 remained in custody for nearly three months and similar circumstanced other co-accused of the case namely Jabbar Mian has already been granted bail by Co-ordinate Bench of this Court, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate East Champaran at Motihari in connection with Muffasil P.S.
