2. The petitioner apprehends his arrest in connection with Rajepur P.S. Case No.217 of 2022, registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code & 6,8,12 of the POCSO Act.
3. As per allegation, the petitioner along with coaccused persons kidnapped the minor grand daughter of the informant.
4. Learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. The main accused Anish Kumar has been granted bail by the coordinate Bench of this Court vide order dated 21.07.2023 in Cr. Misc.
Patna High Court CR. MISC. No.73375 of 2023(2) dt.09-11-2023 2/2 No. 29664 of 2023. The petitioner has falsely been implicated merely because he is co-villager of Anish Kumar.
5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Addl. Sessions Judge-cumSpecial Judge POCSO Act, East Champaran, Motihari in connection with Rajepur P.S. Case No.217 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
