The petitioner is in custody since 31.7.2018 in connection with Samastipur Rail P.S. Case No. 152 of 2018 (G.R. No. 738 of 2018) registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that only on suspicion petitioner was arrested in the instant case. Nothing was recovered from his conscious possession. In the instant case petitioner is in custody since 31.7.2018.

No.54837 of 2018(2) dt.28-09-2018 2/2 Considering the fact that petitioner has no criminal antecedent and he is in custody since 31.7.2018, let the petitioner named above to be released on bail after 21.10.2018 on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-VI-cum- Special Judge, Excise, Samastipur in connection with Samastipur Rail P.S. Case No. 152 of 2018 ( G.R. No. 738 of 2018).
