2. Learned Counsel for the petitioner submits that the present writ petition has been filed for directing the respondent Authority to grant promotional post as Deputy Director from 17.03.2021 and accordingly direct to give all monetary and other benefits to the petitioner.

3. Counsel further submits that the petitioner has filed representation for his grievance which is Annexure-P series.

4. Learned Counsel for the State raised preliminary objection and submits that the present writ petition has been filed for grant of promotion and monetary benefits to the

Patna High Court CWJC No.15638 of 2024(2) dt.08-10-2024 2/2 petitioner. He further submits that the State of Bihar through its General Administration Department notified a rule in the year 2019 i.e., The Bihar Government Servant Grievance Redressal Rules, 2019.

5. It transpires to this Court that the petitioner is a retired employee and the said rule framed by the General Administration Department in the year 2019 i.e., The Bihar Government Servant Grievance Redressal Rules, 2019 is applicable both on employee in service and retired employee.

6. As such, the present writ petition is hereby disposed off directing the petitioner to file his complaint before the Bihar Government Servant Grievance Redressal Officer under the said rule within 30 days from today and the Bihar Government Servant Grievance Redressal Officer, upon considering all the points which the petitioner has raised in the present writ petition, shall decide his grievance according to the said Rule of 2019 strictly within the period specified in the said rule.

7. With the aforesaid directions, the present writ application stands disposed off.
