2. This appeal has been filed for setting aside order dated 14.09.2023 passed in a case registered for the offence punishable under sections 341, 323, 342, 504, 506, 385/34 and
Patna High Court CR. APP (SJ) No.4661 of 2023(5) dt.03-07-2025 2/3 other allied sections of the Indian Penal Code and sections 3(i) ( b ), ( r ) ( s ) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby the prayer for anticipatory bail of the appellant has been rejected. 3 . As per the prosecution case , informant namely Shrawan Das, alleged that on 23.06.2023 , all the accused persons including this appellant abused informant by caste name and assaulted him. It is further alleged that accused persons by putting pistol in mouth of informant assaulted him and threatened to kill him.
4. It is submitted that specific accusation of overt act is against co-accused Sudhir Singh and so far as this appellant is concerned, there is general and omnibus allegation against him. It is not the case of the informant that any member of public was present at the time of incident, as such, no case under SC/ST Act is made out.
5 . Learned the special public prosecutor for the State as well as learned counsel for the respondent No. 2 opposed the bail.
6. Considering the aforesaid facts, this appeal is allowed and the impugned order is set aside. Let the appellant, named above, in the event of arrest/surrender within a period of
