The petitioner, who is in custody, seeks bail in connection with Special Case No. 186 of 2017 arising out of Kotwali P.S. Case No. 698 of 2017 registered for the offence punishable under Section 376 of the Indian Penal Code and Section 4 and 8 of POCSO Act.
Informant has alleged in her written complaint that on 11.12.2017 at 9.00 AM her daughter Bindu Kumari, aged about 15 years disclosed to her that three days earlier Satendra Kumar Singh (petitioner) aged about 50 years, on the point of knife used to commit illegal act with her and always threatened to kill her. On such information, she went there then Satendra Kumar Singh (petitioner) fled away towards station.
Patna High Court Cr.Misc. No.56117 of 2018(2) dt.08-10-2018 2/2 It has been submitted on behalf of the petitioner that petitioner is quite innocent and has been falsely implicated in this case. It has been further submitted that victim girl with her family is residing in Commercial complex Maurya Lok, Patna meaning thereby she is living in a public place. Victim girl was sent for medical examination, in which no finding of rape or sexual assault has been reported. No spermatozoa was found. The age of victim girl has been assessed between 17-18 years. Petitioner has no criminal antecedent and he is in custody since 12.12.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-1st, Patna, in connection with Special Case No. 186 of 2017 arising out of Kotwali P.S.
