JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2020 This application has been filed for modification of the order dated 6.8.2019 passed in Cr.Misc.No. 48817 of 2019 by which the petitioner was directed to surrender on 16.8.2019 and on surrender he was directed to be released on provisional bail on condition that he will keep his wife with him with dignity and care.
Submission of learned counsel for the petitioner is that later on he came to know that his wife is pregnant, as such he is not ready to keep her and for that this modification has been filed.
Heard learned APP also.
Considering the submission made above it appears
Patna High Court CR. MISC. No.71935 of 2019(2) dt.29-01-2020 2/2 that the order was passed after hearing learned counsel for the petitioner and now petitioner has changed his stand only to deny marital relationship between the parties.
In such view of the matter, I am not inclined to interfere with the earlier order passed by this Court. Accordingly, this application is dismissed.
However, petitioner is directed to surrender and pray for regular bail.
