JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-05-2024 The present writ has been filed seeking the following reliefs:- "1(i). For issuance of appropriate writ / writs, order/orders, direction to the Respondent authorities particularly Circle Officer, Nasriganj Rohtas to remove the encroachment from Khata No. 160, Khesra No. 471 which happens to be a Aam Rasta (PCC road that leads to Kabristan (Graveyard), Sirsha Bigha Tola and Govind Bigha) and same is being used by the villagers along with the petitioner common way.

Patna High Court CWJC No.15258 of 2023(2) dt.03-05-2024 2/2 (ii). To direct the respondent authorities not to settle the public land that is Khata No, 160, Khesra no. 471 which is used as passage by the villagers along with the petitioner in favour of private respondent."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Respondent No. 5, i.e. the Circle Officer, Nasriganj, Rohtas, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

Accordingly, the writ petition stands disposed off as not pressed.
