The petitioner seeks bail in connection with Jogbani P.S. Case No. 17 of 2018 dated 22.01.2018 instituted for the offence under Section 392 of the Indian Penal Code.
The petitioner has not been named in the FIR and his complicity in this case has surfaced only on the basis of suspicion and confession of a co-accused. There is no recovery from the possession of the petitioner. The earlier cases in which the petitioner has been made accused are all such cases in which the FIR has been registered against unknown. However, the petitioner has been granted bail in all such cases.
In the present case, the petitioner is in custody
Patna High Court Cr.Misc. No.54540 of 2018(2) dt.04-09-2018 2/2 since 25.05.2018.
Considering the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jogbani P.S. Case No. 17 of 2018.
