The petitioner is in custody in connection with Case No. C2/399/18 for the offence under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He has been arrested in connection with seizure of 51 liters of Nepali Saufi Wine. Learned counsel submits that nothing was recovered from the possession of the petitioner. The petitioner is in custody since 30.07.2018.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 30.07.2018, the petitioner,

Patna High Court Cr.Misc. No.54963 of 2018(2) dt.28-09-2018 2/2 named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each after 21.10.2018 to the satisfaction of the Additional District Judge II-cum-Special Judge, Excise Act, Sitamarhi in connection with Case No. C2/399/18.
