1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Alamganj P.S. Case no. 904 of 2025 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, on information having been received about the petitioner having stored liquor, it is stated that a raid was conducted in which 17.28 litres of IMFL was recovered from the street near the house of the petitioner.

4. Learned counsel for the petitioner submits that from the FIR itself, it would transpire that no incriminating article has been recovered either from the possession or the house of the petitioner and the alleged recovery is from a public

Patna High Court CR. MISC. No.68485 of 2025(2) dt.08-10-2025 2/2 street, accessible to all. The petitioner has no criminal antecedent and undertakes to cooperate in the case.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R., the alleged place of recovery of the liquor together with the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Alamganj P.S. Case no. 904 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court, Excise, Patna City, Patna.
