The petitioner seeks bail in Shambhuganj P.S. Case No.22 of 2018 registered for the offences under Sections 392 and 411 of the I.P.C.

Allegation as per the F.I.R. is that some miscreants hired tempo and thereafter on the point of knife after getting him down they had taken away his tempo.

Submission on behalf of the learned counsel for the petitioner is that he is not named in the F.I.R. but later on his name transpired only on the basis of confessional statement of coaccused. Though he is accused in seven more cases but he is on bail in all cases except one. He is ready to abide by the conditions imposed upon him. He is in custody since 16.04.2018.

Having heard both sides and in view of the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Banka, in Shambhuganj P.S. Case No.22 of 2018 subject to the condition that one of the bailors must be of local person having sufficient properties within the jurisdiction of the court concerned and if in future he is found to be indulged in such type of cases, the prosecution shall proceed for cancellation of his bail bond.
