1. Heard learned counsel for the petitioner, learned APP for the State along with learned counsel appearing on behalf of the O.P. No.2.
2. The learned counsel for the petitioner submits that petitioner seeks anticipatory bail in a case registered under Section 498(A), 406 and 34 of the IPC read with Section 3 & 4 of the Dowry Prohibition Act.
3. The learned counsel for the parties jointly submitted that the case was referred for mediation and the dispute in between the petitioner and the O.. No.2 stands resolved amicably and they are leading a peaceful conjugal live.
4. The learned counsel appearing on behalf of the O.P. No.2, Mr. Jitendra Kumar Bharti submits that he has instruction
Patna High Court CR. MISC. No.75320 of 2023(3) dt.22-04-2024 2/2 not to oppose the anticipatory bail application of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Ist, Jhanjharpur, Madhubani in connection with Lakhnaur (R.S. O.P.) P.S. Case No.113 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
