The petitioner seeks bail in connection with Lakhisarai P.S. Case No. 330 of 2025 instituted for the offence under Sections 126(2), 115(2), 352, 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 25(9) of the Arms Act.

The prosecution case, in short, is that on 06.07.2025 at about 9:20 p.m., petitioner, Dev Kumar, and Golu Kumar entered the informant's house, abused, assaulted, and threatened him at gunpoint. The incident was captured in CCTV footage, leading to the lodging of the present FIR.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.07.2025. Petitioner bears three criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that petitioner and informant are co-villager and there is dispute over tractor passing. There is no specific allegation against the petitioner, rather the same is general and omnibus in nature. Other coaccused has been granted bail by this Court vide order dated 09.10.2025, passed in Cr. Misc. No. 70152 of 2025. 6.

Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, claim based on parity and there being no specific material against the petitioner, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
