JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-12-2019 Petitioner seeks regular bail in connection with Bettiah Muffasil P. S. Case No.321 of 2019, registered for the offences punishable under Section 387 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. As per F.I.R. there is allegation of recovery of country made pistol from the possession of the petitioner. Apart from that, he is accused in five other cases, four are of Excise Act and one is under Arms Act.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. He has drawn my attention towards Annexure-2. He is in custody for about 06 months.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation and

Patna High Court CR. MISC. No.74121 of 2019(3) dt.09-12-2019 2/2 antecedent, at this stage, I am not inclined to grant bail to the petitioner. However, if the trial is not concluded within a period of six months, petitioner is at liberty to renew his prayer for bail. With the above observations, this application is dismissed.
