JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-06-2020 Heard learned counsel for the petitioner, learned counsel of opposite party no. 2 as well as learned Additional Public Prosecutor for the State through video conferencing. Petitioner was granted provisional bail vide order dated 04.11.2019 and subsequently, petitioner agreed before this court to take the opposite party no. 2 back to his home on 04.03.2020 but submission on behalf of opposite party no. 2 is that petitioner did not take any step to take the opposite party no. 2 back to his house.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition

Patna High Court CR. MISC. No.66409 of 2019(4) dt.17-06-2020 2/3 stands disposed of with direction to petitioner and opposite party no. 2 to appear before the court of learned Chief Judicial Magistrate, Aurangabad/concerned court in connection with Complaint Case No. 57 of 2019 when the concerned court directs to appear the parties. Furthermore, the learned court below shall issue notices to petitioner as well as opposite party no. 2 for their appearance before the concerned court fixing specific date when the concerned court starts functioning physically.

Furthermore, after appearance of the parties, the concerned court shall take steps to reconcile the dispute of the parties amicably and if conciliation proceeding fails due to rigid and non cooperative approach of the petitioner, the concerned court shall be at liberty to take the petitioner in custody and if any regular bail petition is filed, the concerned court shall pass appropriate order on the regular bail petition of the petitioner on its own merit without being prejudiced by this order. However, if the reconciliation fails due to non cooperative and rigid approach of opposite party no. 2, the concerned court shall confirm the provisional bail granted to the petitioner fixing the amount of bail bonds on its own level.

Patna High Court CR. MISC. No.66409 of 2019(4) dt.17-06-2020 3/3 provisional bail granted to the petitioner by this court and shall dispose of aforesaid Complaint Case No. 57 of 2019 after recording the statement of petitioner and opposite party no. 2 without any delay.
