The petitioner is apprehending his arrest in connection with Akodhigola P.S.Case No.120 of 2019 registered for offences punishable under Section 366 of the Indian Penal Code.

As per FIR, petitioner is said to have abducted the wife of the informant.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case on the basis of suspicion and there is no eye witness of the case and as a matter of fact she has fled away with another person and he has been falsely implicated in this case and the mobile number belongs to one Gautam Paswan. On the other hand the learned counsel for the informant has opposed the prayer for bail on the ground that

Patna High Court CR. MISC. No.64715 of 2019(2) dt.16-10-2019 2/2 prior to lodging of the case the petitioner had come to his house and some witnesses have seen the petitioner going along with his wife.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
