The petitioner apprehends his arrest in connection with Nadi P.S. Case No.187 of 2020, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 427, 332, 333, 188, 353, 120(B) and 504 of the Indian Penal Code. The petitioner alongwith other co-accused persons is said to have assaulted Arun Kumar causing injuries to him. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the allegation against the petitioner is general and omnibus. It is also submitted that the petitioner was identified by CCTV footage.

Patna High Court CR. MISC. No.69396 of 2022(2) dt.28-02-2023 2/2 Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner by submitting that petitioner was also involved in the present case. Taking into consideration the facts that no specific overt act is alleged against the petitioner and petitioner was only the member of the mob, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City in connection with Nadi P.S. Case No.187 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
