The petitioner, who is in custody, seeks bail in connection with Special Case No. 5065 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against petitioner is of recovery of 2142 litres of foreign liquor from the truck.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. Petitioner was apprehended while he was passing through road. The driver of the truck had fled away. Petitioner has no concern with truck or liquor concealed in the

Patna High Court Cr.Misc. No.54983 of 2018(2) dt.05-10-2018 2/2 truck. Nothing was recovered from possession of petitioner. Petitioner has no criminal antecedent and he is in custody since 31.05.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 5065 of 2018.
