2.The petitioner seeks bail in connection with Raghopur (Rustampur O.P.) P.S. Case No. 102 of 2023 registered for the offence under Section 304/34 of the Indian Penal Code and police after investigation submitted chargesheet under Section 302.

3. As per the prosecution case, the petitioner and his father has deliberately put live wire to protect their field and because of the same the son of the informant died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to village politics.

5. It is also submitted by the learned counsel for the petitioner that the petitioner has no criminal antecedent and he is in jail since 29.05.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Raghopur (Rustampur O.P.) P.S. Case No. 102 of 2023.
