The petitioner is apprehending his arrest in connection with Nagar (Sadar) P.S.Case No.287/19 registered for offences punishable under Sections 341, 323, 324, 307/34 of the Indian Penal Code.

As per FIR there was altercation between the petitioner and the informant and the matter was pacified. Later on he came along with the other accused persons and stabbed the the informant causing injury to him.

Submission of the learned counsel for the petitioner is that there is inordinate delay in lodging of the FIR and there is no repetition of the blow.

Heard learned A.P.P. , who has opposed the prayer for

Patna High Court CR. MISC. No.68562 of 2019(2) dt.25-10-2019 2/2 bail. .

Having heard both sides and in view of the facts and circumstances, as stated above, as the nature of the injury is not available as such this application is disposed of with a direction to the petitioner to surrender and on surrender he will be released on provisional bail in connection with Nagar (Sadar) P.S.Case No.287 of 2019 dated 29.5.2019 to the satisfaction of the court below and case diary and the injury report were called for and once they are received and injuries are found to be simple, the learned court below shall confirm the provisional bail of the petitioner, otherwise bail bond of the petitioner shall be cancelled.

With the aforesaid direction, this application is disposed of.
