====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-01-2025 Petition for pre-arrest bail of petitioner nos.1 and 2 is dismissed as withdrawn.
2. Heard learned counsel for the petitioner no. 3 and 4 and the State.
3. Petitioners apprehend arrest in connection with Noorsarai P.S. Case No. 244 of 2024 registered under Sections 147, 148, 149, 341, 324, 325, 307, 504 and 379 of the Indian Penal Code and Section 27 of the Arms Act.
4. As per prosecution case, 15 named and 15 to 20 unknown accused persons including these petitioners assaulted informant by means of lathi, iron rod and sword, on account of which informant sustained injury.
5. Learned counsel appearing for the petitioners submits that allegation of assault is general and omnibus against these petitioners and no specific overt act has been alleged
Patna High Court CR. MISC. No.72174 of 2024(3) dt.18-01-2025 2/2 against them. Doctor has found simple injury. Co-accused, with similar allegation, have already been allowed pre-arrest bail by this Court vide order passed in Cr.Mis.No.61882 of 2024.
6. Learned counsel for the State opposed the bail application and submits that petitioners are named in the First Information Report. There is specific allegation of assault against these petitioners.
7. Considering the facts of the case and the nature of injury caused by these petitioners, prayer for bail of the petitioners no. 3 qand 4 is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Nalanda at Biharsharif in Noorsarai Police Station Case No. 244 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
