2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 329 (3) , 109 and 3 (5) of the BNS.
3 . As per the prosecution case , informant namely , Sarbjit Kumar alleged that on 01.04.2025 at about 10 O' Clock , on the instigation of petitioner No. 1 , co-accused Sanjeev Kumar Toni @ Ravindra Yadav , Billu Gope and Rahul Gope fired upon wife and mother of informant due to which they sustained firearms injury .
4. It is submitted on behalf of the petitioners that it is

No.69993 of 2025(2) dt.07-10-2025 2/2 a specific case of the informant that co-accused persons namely , Sanjeev Kumar Toni @ Ravindra Yadav , Billu Gope and Rahul Gope fired, as a result of which, wife and mother of informant sustained firearm injury . So far as, petitioner No. 1 is concerned, he is only alleged to be order giver and there is no allegation of any overt act against these petitioners. Petitioners claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the aforesaid facts, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM -II Danapur in connection with Bihta P.S. Case No. 223 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
