JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Forbesganj P.S. Case No. 637 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 326, 307, 364 and 379 of the Indian Penal Code. As per FIR there is allegation against the petitioners and other accused persons that they came variously armed and assaulted the informant and others and there is also allegation that petitioners had kidnapped his brother Md. Saovar and he is still traceless and petitioners are accused in other cases also.

Submission of learned counsel for the petitioners is that cases are going on between the parties and so far keeping of Md.

Patna High Court CR. MISC. No.67957 of 2019(3) dt.15-11-2019 2/2 Saovar is concerned, a station diary entry has been made at Rajasthan in that connection and there is no specific allegation against petitioners and considering the same co-accused persons have been granted anticipatory bail by co-ordinate Bench of this Court by order dated 15.10.2019 passed in Cr.Misc.No. 59864 of 2019. Heard learned APP also.

In view of above facts and circumstances, let petitioners surrender in the court below within a period of three weeks from the receipt of this order and on surrender they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 637 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that petitioners have to co-operate in the investigation and appear before the I.O. as and when required.
