JUSTICE SOURENDRA PANDEY ORAL ORDER 31-10-2025 Learned counsel for the petitioner is permitted to make necessary correction with regard to the P.S. Case mentioned in paragraph nos. 4 & 5 of the petition.

2. Heard Mr. Nafisu Zzoha, the learned counsel for the petitioner and Mr. Jitendra Kumar Singh, the learned APP for the State.

3. The present modification application has been filed for extension of further four weeks' time as well as for modifying the order dated 29.08.2025 passed by this Court in Cr. Misc. No. 58518 of 2025 whereby the petitioner was granted the liberty of anticipatory bail with the condition that "the

No.72534 of 2025(2) dt.31-10-2025 2/3 learned Court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification"

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner had in fact through a supplementary affidavit filed in the earlier case i.e. Cr. Misc. No. 58518 of 2025 pointed out that one case was there against the petitioner being Gopalganj Nagar P.S. Case No. 62 of 2022, however the same was not incorporated in the order dated 29.08.2025, whereby the petitioner was granted anticipatory bail.

5. Learned counsel for the petitioner further submits that the petitioner also came to know about one another case being Gopalganj P.S. Case No. 56 of 2022 which was lodged for the same occurrence, however he was not aware of the same but subsequently the said two cases have been amalgamated and the trial has commenced jointly.

6. In view of the aforesaid, let the order dated 29.08.2025 passed in Cr. Misc. No. 58518 of 2025 be modified to the extent that instead of petitioner having no criminal

Patna High Court CR. MISC. No.72534 of 2025(2) dt.31-10-2025 3/3 antecedent as stated in paragraph no.4 of the said order it may be read as "petitioner has two criminal antecedents against him being Gopalganj Nagar P.S. Case No. 62 of 2022 and Gopalganj Nagar P.S. Case No. 56 of 2022".

7. The order dated 29.08.2025 passed in Cr. Misc. No. 58518 of 2025 is modified to the aforesaid extent.

8. The petitioner shall be at liberty to furnish the bail bonds by 05.12.2025.
