JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Town P.S. Case No. 142/2018, instituted for the offences under Sections 411, 313, 414 and 34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is in custody since 19.05.2018. He has no criminal antecedent.

In the written report, it is alleged that on secret information that one suspected person has been seen near Kashipur Hanuman Mandir with theft motorcycle and again trying to steal motorcycle, the police party reached near Kashipur Hanuman Mandir and found that one person is riding on a

Patna High Court Cr.Misc. No.55380 of 2018 (2) dt.20-09-2018 2/2 motorcycle, which is without number plate. The police apprehended him and demanded valid paper for the same, but he could not produce the same. The apprehended person disclosed his name as Abhiranjan Kumar @ Bittu. From his possession four keys of motorcycles were recovered. He told that he used to steal motorcycles with other associates and sell it in different places in the district of Muzaffarpur. On his confessional statement, the police recovered altogether 12 theft motorcycles from different places including the house of this petitioner. Learned counsel for the petitioner has submitted that in the seizure-list it is mentioned that aforesaid motorcycle was recovered from the joint residential house of the petitioner.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Town P.S. Case No. 142/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
