2. The petitioners seek regular bail in connection with Kateya P.S. Case No. 108 of 2023 registered for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 307, 302, 504, 506 of the IPC.
3. As per prosecution case, the allegation against the petitioners is to commit murder of the informant's son namely, Balister Ram along with other co-accused persons causing head and bodily injuries. The alleged occurrence took place in the background of longstanding land dispute.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.71755 of 2023(4) dt.18-01-2024 2/2 petitioners are innocent and have committed no offence. They have falsely been implicated in this case due to land dispute. From perusal of FIR, the specific allegation is against coaccused Rudal Ram who assaulted the deceased by means of Farsa due to which he succumbed to injuries. These petitioners are not named in the FIR. No specific overt-act attributed against these petitioners. Other co-accused persons have already been enlarged on bail vide Annexure-4 series. The petitioners have got no criminal antecedents as stated in para-3 of the bail petition and languishing in judicial custody since 24.6.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Kateya P.S. Case No. 108 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Gopalganj.
