JUSTICE SANJAY PRIYA ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barahat P.S. Case No. 28 of 2018 instituted for the offence under Sections 147, 148, 149, 302, 201, 427 of the Indian Penal Code, 3⁄4 of Prevention of Damage of Public Property Act, Sections 27 of the Arms Act, Sections 9, 10, 13, 16, 18, 20 and 231 of U.A.P. Act. It is alleged in the written report that dead body of Madan Kora was found lying in the common room of the school and dead body of Pramod Kora was found lying in the wheat field near northern side of the school. The younger brother of the deceased namely Ranjeet Kora disclosed the name of several persons as mentioned in the written report. The name of petitioner has also been mentioned at item No.58 of the case

In such circumstances, besides suspicion there is no specific allegation of overt act against the petitioner. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajandeo, Judicial Magistrate, 1st Class, Jamui, in connection with Barahat P.S. Case No. 28 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
